Walking Tour Liability Waiver and Assumption of Risk Agreement

1. Acknowledgment and Acceptance of Risk

By purchasing a ticket and participating in the Mango Farm Walking Tour (“Tour”), I acknowledge that I have voluntarily chosen to take part in a walking tour conducted on operating agricultural properties. I understand that participation involves exposure to certain inherent hazards, including but not limited to:

  • Uneven or slippery ground surfaces
  • Irrigation lines, hoses, and other agricultural equipment
  • Nursery pots, wire benches, and tools
  • Farm vehicles in operation
  • Exposure to insects, including but not limited to honey bees, ants, and mosquitoes
  • Contact with plants, trees, or organic materials that may cause allergic reactions or minor injuries
  • Variations in weather and temperature conditions

I understand that these and other hazards can result in minor or serious injury, illness, or damage to property, and that FMA, its member farms, and associated personnel cannot eliminate all such risks without fundamentally altering the nature of the tour.

2. Assumption of Risk

I freely and voluntarily assume all risks, known and unknown, associated with participation in this Tour. I recognize that I am personally responsible for exercising caution and good judgment while on the premises of each participating farm.

3. Release and Waiver of Liability

In consideration for being permitted to participate in the Tour, I, on behalf of myself, my heirs, executors, and assigns, hereby release, waive, discharge, and hold harmless Florida Mango Association LLC, Tropical Acres Farms, Truly Tropical, their owners, officers, employees, volunteers, agents, and affiliates (collectively “Released Parties”) from and against any and all claims, actions, liabilities, losses, damages, or expenses—including those arising from the negligence of the Released Parties—that may result from my participation in the Tour.

This release applies to any injury (including death), illness, or property damage occurring during or resulting from participation in the Tour.

4. Health and Safety

I certify that I am physically able to participate in a walking tour on uneven terrain and in outdoor conditions. I agree to follow all posted signs, safety instructions, and verbal directions given by any Tour staff or representatives.

I further agree to refrain from touching or consuming any fruit, plant, or product on the farms unless expressly permitted by Tour organizers.

5. Photographs and Media

I grant the Florida Mango Association LLC permission to photograph or record me during the Tour and to use such images or recordings for promotional or educational purposes, without compensation.

6. Governing Law and Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. If any part of this Agreement is found to be invalid or unenforceable, the remaining sections shall remain in full force and effect.

7. Acknowledgment and Agreement

By purchasing a ticket for this event, I acknowledge that I have read, understood, and voluntarily agreed to the terms of this Liability Waiver and Assumption of Risk Agreement. I understand that this document affects my legal rights and agree to be bound by its terms.
